Terms and Conditions

These Terms govern your use of the Bro Dewata website, customer booking services, and the Bro Dewata driver application.

Important summary

By accessing the Platform, creating an account, making a booking, registering as a driver, accepting a job, or otherwise using a Bro Dewata service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Platform or Services.

Part A

General Terms

1. Definitions

In these Terms:

Bro Dewata
means the brand, Platform, and Services operated by PT BERSAMA BISA ADA.
Platform
means the Bro Dewata website, driver application, dashboards, APIs, payment pages, and other digital systems used to provide Services.
User
means anyone who accesses or uses the Platform, including Customers, passengers, account holders, and Drivers.
Customer
means a person who searches for, books, pays for, or uses a Service through Bro Dewata.
Driver
means a person who registers or is approved to receive and perform jobs through the Bro Dewata driver application.
Partner
means a driver, vehicle operator, activity provider, accommodation provider, guide, vendor, or other third party involved in providing a Service.
Booking
means a request for a Service that has been confirmed by Bro Dewata.
Services
may include private transportation, airport transfers, point-to-point transport, vehicle rental, tours, travel packages, activities, itinerary support, and related travel services.

2. Scope and acceptance

These Terms apply to:

  • use of the Bro Dewata website and public booking flows;
  • creation and use of Customer accounts;
  • searching, booking, paying for, and using Services;
  • Driver registration, verification, onboarding, and account use;
  • acceptance and performance of Driver jobs; and
  • communications through the Platform, email, WhatsApp, telephone, push notification, or other official channels.

Additional terms may apply to a specific Service. Those terms may appear on a product page, booking summary, invoice, voucher, itinerary, Driver offer, written agreement, or confirmation message. Where a specific term clearly conflicts with these general Terms, the specific term applies to that Service.

3. Eligibility and authority

To use the Platform or make a Booking, you must:

  • have legal capacity to enter into an agreement;
  • provide accurate, complete, and current information;
  • not use another person's identity without permission;
  • keep your account and device secure; and
  • use the Platform only for lawful purposes.

If you make a Booking for another person, you confirm that you are authorised to provide their information and accept relevant booking conditions on their behalf. A minor or person without legal capacity must use the Services with the consent and supervision of a parent, guardian, or other legally authorised person.

4. Accounts and security

You are responsible for activity carried out through your account and device. You must contact Bro Dewata promptly if:

  • your password, access token, or account may have been compromised;
  • you notice activity you do not recognise;
  • your device is lost or stolen; or
  • you suspect fraud or unauthorised access.

Bro Dewata may restrict, suspend, or deactivate an account where there is suspected fraud, misuse, a security risk, unlawful activity, or a breach of these Terms.

5. Bro Dewata's role and third-party Partners

Bro Dewata may provide some Services directly. For other Services, Bro Dewata may act as an agent, coordinator, marketplace, or intermediary connecting Customers with Partners. The identity of the service provider or the nature of Bro Dewata's role may be stated on the product page, booking confirmation, voucher, invoice, itinerary, or another official communication.

Where a Partner performs a Service, Bro Dewata may still coordinate the Booking, collect payment, provide Customer support, and assist with complaints within the reasonable scope of the Booking.

Part B

Terms for Customers

6. Service information

Bro Dewata aims to present accurate information about:

  • the type and scope of a Service;
  • vehicle category, passenger capacity, and luggage capacity;
  • pickup, destination, stops, and itinerary;
  • schedule, duration, inclusions, and exclusions;
  • facilities and usage requirements; and
  • estimated or confirmed pricing.

Images of vehicles, destinations, rooms, activities, or facilities may be illustrative. The actual unit, colour, model, Driver, route, or facility may differ while remaining within the confirmed category or service standard.

Typographical errors, technical errors, availability changes, or outdated information do not automatically bind Bro Dewata. If a material error is found after a Booking request, Bro Dewata will provide a correction, a reasonable alternative, or an option to cancel before the affected Service proceeds.

7. Booking requests and confirmation

A request submitted through the Platform is not a confirmed Booking until Bro Dewata issues an official confirmation. Confirmation may be provided through the Platform, email, WhatsApp, voucher, invoice, or another official channel.

Bro Dewata may request additional information before confirming a Booking, including flight details, an accurate pickup point, passenger and luggage counts, child-seat needs, accessibility requirements, contact details, or other journey information.

You must review the confirmation and report any error as soon as possible.

8. Prices, inclusions, and payment

The applicable price will be displayed or communicated before final payment or confirmation.

A price may include or exclude items such as:

  • vehicle and Driver services;
  • fuel, parking, tolls, and waiting time;
  • entrance tickets and reservations;
  • overtime, special pickup, or route-extension charges;
  • food, accommodation, guide services, and activities;
  • taxes, payment processing fees, or other charges.

Inclusions and exclusions will be stated on the Service page, booking summary, invoice, itinerary, or confirmation. Payment may be processed by Midtrans, Xendit, or another third-party payment provider. Your use of a payment method is also subject to the provider's terms.

You are responsible for ensuring that:

  • the payment method is valid and authorised;
  • the balance or credit limit is sufficient;
  • the payment information is correct; and
  • the payment is not fraudulent or unlawful.

Bro Dewata does not directly store full card details where payment is handled by a third-party payment provider.

9. Changes and rescheduling

Requests to change a date, time, location, passenger count, vehicle, itinerary, or other Service detail must be made as early as possible. Approval depends on availability, notice period, route or duration changes, Partner conditions, third-party costs, and the price applicable to the revised Service.

Any additional charge will be communicated before the change is confirmed.

10. Cancellation, refunds, and no-show

Cancellation and refund rules may vary by Service. The applicable rule will be displayed or communicated on the Service page, booking summary, voucher, invoice, or confirmation.

A refund may be affected by:

  • the time between cancellation and the scheduled Service;
  • the type of Service and work already performed;
  • payment processing charges;
  • amounts already committed or paid to Partners;
  • non-refundable tickets or reservations; and
  • specific conditions accepted when the Booking was made.

You may be treated as a no-show if you are not present at the agreed location, cannot be contacted, or fail to provide sufficient pickup information after the applicable waiting period. A no-show may be treated as a Customer cancellation and may result in part or all of the payment becoming non-refundable.

An approved refund will be processed through an available method. The time required for funds to appear depends on the relevant bank, card issuer, digital wallet, or payment provider.

11. Customer responsibilities and conduct

Customers and passengers must:

  1. provide accurate Booking information;
  2. be present on time at the agreed location;
  3. keep passengers and luggage within the confirmed vehicle capacity;
  4. follow reasonable safety instructions;
  5. behave respectfully toward Drivers, staff, Partners, and other people;
  6. not carry dangerous, illegal, or prohibited items;
  7. supervise children and vulnerable passengers;
  8. look after personal belongings; and
  9. pay agreed additional charges resulting from Customer-requested changes.

Bro Dewata or a Driver may refuse or stop a Service where there is violence, harassment, unlawful conduct, vehicle damage, unsafe behaviour, excessive passenger or luggage load, or another serious safety risk.

12. Transport, vehicles, and journey timing

Journey times are estimates. Actual timing may be affected by traffic, weather, ceremonies, road closures, accidents, queues, security checks, flight changes, or other conditions. Customers must allow sufficient time for flights, boats, events, appointments, and onward travel.

Bro Dewata does not guarantee completion within a particular time where delay is caused by circumstances outside reasonable control. Valuable items should remain under the Customer's supervision. Bro Dewata may provide reasonable assistance to locate property left behind but cannot guarantee recovery. Any return or delivery cost is normally the Customer's responsibility unless agreed otherwise.

13. Tours, packages, and itineraries

An itinerary may change because of weather, road conditions, destination closures, ceremonies, venue capacity, safety concerns, delays, or operator decisions. Bro Dewata may adjust the order of visits or offer a reasonably comparable alternative after considering the Customer's interests and operational conditions.

Tickets, reservations, meals, guides, accommodation, and other facilities are included only when clearly stated in the Booking details.

14. Third-party services

A third-party provider may have its own usage terms, cancellation rules, safety requirements, age restrictions, privacy practices, and liability limits. Bro Dewata may assist with coordination and problem resolution, but does not control every act, omission, facility, or operational decision of an independent third party.

Part C

Terms for Drivers

15. Driver registration and verification

A Driver must provide accurate information and complete Bro Dewata's registration and verification process. Information and documents may include:

  • identity details and profile photograph;
  • Indonesian identity card (KTP) and a selfie with the identity card;
  • driving licence (SIM);
  • police clearance certificate (SKCK), where required;
  • vehicle registration certificate (STNK);
  • vehicle details and photographs;
  • emergency contact information;
  • bank account details;
  • operating area and supported Service types; and
  • other information reasonably required for safety, compliance, or operations.

The Driver confirms that all information and documents are genuine, valid, current, accurate, and not altered or falsified.

Registration does not guarantee approval. Bro Dewata may conduct checks, request additional information, reject an application, require re-verification, or suspend an account where requirements are not met.

16. Nature of the Driver relationship

The legal and commercial relationship between a Driver and Bro Dewata is governed by the applicable written agreement, operational model, and law. These Terms alone do not determine that a Driver is an employee, contractor, agent, representative, or partner in any particular legal form.

A Driver may not make promises, provide warranties, collect unauthorised payments, enter into agreements, or act on behalf of Bro Dewata without authority.

17. Driver account use

A Driver account is personal and may be used only by the verified Driver. A Driver must not:

  • lend, sell, rent, transfer, or share the account;
  • use another person's account;
  • share passwords, access tokens, or authentication codes;
  • allow another person to perform a job in the Driver's place;
  • manipulate identity, location, availability, job, or payment data; or
  • use software or devices intended to interfere with Bro Dewata systems.

The Driver is responsible for activity carried out through the Driver account and registered device.

18. Online status and job offers

A Driver may receive job offers when the account is active, verification requirements are complete, and online availability is enabled. A job offer may include Service type, pickup time, locations, passenger and luggage details, required vehicle, itinerary, and payment information.

Before accepting a job, the Driver must review the offer and confirm that the Driver:

  • is available and able to arrive on time;
  • has a suitable, roadworthy, and properly documented vehicle where required;
  • can safely carry the confirmed passengers and luggage;
  • understands the route, itinerary, and operational requirements; and
  • can meet Bro Dewata's service standards.

A Driver must not accept a job that cannot be completed safely, legally, or on time.

19. Rejection and cancellation of jobs

A Driver may reject an offer before acceptance through the available application process. After acceptance, cancellation should occur only for a legitimate reason such as an emergency, accident, vehicle failure, health issue, safety concern, or another reason that can be properly explained.

The Driver must notify Bro Dewata immediately and provide truthful information. Repeated cancellation, cancellation without reasonable cause, or failure to attend after acceptance may affect job access and account status.

20. Driver service standards

A Driver must:

  1. arrive on time and communicate material delays;
  2. maintain a clean, safe, and suitable vehicle;
  3. maintain appropriate personal presentation and hygiene;
  4. behave politely, professionally, and without discrimination;
  5. follow the confirmed itinerary and reasonable operational instructions;
  6. provide reasonable assistance to passengers;
  7. drive safely and comply with traffic law;
  8. avoid dangerous phone use while driving;
  9. never drive under the influence of alcohol, narcotics, or an impairing substance;
  10. not smoke in the vehicle while providing a Service;
  11. protect Customer privacy and confidential information; and
  12. report operational, safety, or Customer issues promptly.

A Driver must not add unauthorised passengers, substitute a vehicle, transfer a job, materially change an itinerary, or request an additional payment without approval.

21. Vehicle compliance and safety

A Driver using a vehicle must ensure that it:

  • has valid registration and any legally required documentation;
  • is roadworthy and regularly maintained;
  • matches the approved category and capacity;
  • is clean and safe for passengers;
  • contains required safety equipment; and
  • meets any additional standard communicated for a Service.

The Driver is responsible for traffic violations, unsafe driving, and vehicle obligations within the Driver's control, unless a written agreement states otherwise. A Driver must stop or refuse a journey where the vehicle or situation is unsafe.

22. Location, journey status, and notifications

The driver application may use device location to:

  • determine availability and offer relevant jobs;
  • support navigation and dispatch;
  • monitor performance of an accepted Service;
  • record arrival and journey progress;
  • improve safety and support incident handling; and
  • detect fraud or misuse.

The Driver must provide accurate status updates, including when travelling to pickup, arriving, starting a trip, reaching itinerary stops, completing a trip, or experiencing a problem. GPS spoofing, false-location tools, or inaccurate journey status updates are serious breaches of these Terms.

Bro Dewata may use push notifications, SMS, WhatsApp, telephone, or other channels for job offers and operational messages.

23. Customer information and confidentiality

Customer information may be used only as necessary to perform an accepted job. A Driver must not:

  • retain Customer data without a legitimate operational need;
  • share a Customer's telephone number, address, itinerary, photograph, or identity;
  • contact a Customer after a job for an unrelated or personal purpose;
  • use Customer data for marketing or solicitation;
  • publish conversations, booking details, or journey information;
  • photograph or record a Customer without permission; or
  • improperly move a Customer or transaction outside the Platform.

This confidentiality obligation continues after the job ends and after the Driver account is deactivated.

24. Driver earnings and payouts

Job value, commission, incentives, deductions, administrative charges, and payout schedules may be communicated through the application, dashboard, written agreement, or another official channel. A Driver must provide a valid bank account consistent with the verified identity.

Bro Dewata may make a reasonable payment adjustment for:

  • a calculation error or duplicate payment;
  • a cancellation or approved Customer refund;
  • a job that was not completed;
  • an unauthorised charge;
  • a breach of these Terms; or
  • suspected fraud under investigation.

A Driver should raise a payout dispute through an official support channel and identify the relevant job.

25. Accidents and incidents

A Driver must promptly report:

  • an accident, injury, or vehicle damage;
  • a dispute or serious complaint involving a Customer;
  • lost property;
  • criminal activity or a threat to safety;
  • contact with authorities connected to a job; or
  • another serious operational incident.

Human safety takes priority in an emergency. The Driver must contact emergency services or authorities when required, provide accurate information, preserve relevant evidence where safe to do so, and cooperate with a reasonable investigation.

26. Driver suspension and deactivation

Bro Dewata may warn, restrict, suspend, or deactivate a Driver account because of:

  • false, expired, or missing documents;
  • account sharing, GPS manipulation, or system misuse;
  • payment fraud or unauthorised charges;
  • unauthorised job transfer;
  • unsafe conduct, violence, harassment, or discrimination;
  • privacy or confidentiality breaches;
  • serious or repeated complaints;
  • repeated unexplained cancellations or poor performance;
  • unlawful activity; or
  • another material breach of these Terms.

Bro Dewata may investigate before making a final decision. A Driver may submit an explanation or appeal through an official channel, but an appeal does not automatically remove an active restriction while the matter is reviewed.

Part D

Platform and Legal Terms

27. Prohibited use

A User must not:

  • use the Platform for an unlawful purpose;
  • access an account, system, or data without authorisation;
  • interfere with servers, APIs, applications, or security controls;
  • scrape or automatically collect data without permission;
  • introduce malware or harmful code;
  • create a false Booking or fraudulent account;
  • make an improper chargeback;
  • manipulate pricing, promotions, locations, availability, or status;
  • impersonate another person; or
  • harass or harm another User.

Bro Dewata may take technical, contractual, and legal action against misuse.

28. Intellectual property

Bro Dewata names, marks, logos, designs, software, text, photographs, videos, databases, and other materials are protected by intellectual property law. A User receives only a limited, revocable right to use the Platform for its intended purpose.

A User may not copy, sell, modify, distribute, reverse engineer, or commercially exploit any part of the Platform without written permission, except where applicable law expressly permits it.

29. Platform availability

Bro Dewata aims to keep the Platform available and secure but does not guarantee uninterrupted operation. Access may be interrupted by maintenance, upgrades, network failure, third-party outages, security incidents, emergencies, or events outside reasonable control.

Bro Dewata may add, change, restrict, or discontinue a feature while taking reasonable account of active Bookings and jobs already in progress.

30. Events outside reasonable control

Bro Dewata is not responsible for failure or delay caused by an event outside reasonable control, including:

  • natural disaster or severe weather;
  • epidemic or pandemic;
  • war, civil unrest, or terrorism;
  • government action or regulatory restriction;
  • road, airport, harbour, venue, or destination closure;
  • religious or cultural ceremony affecting access;
  • transport, electricity, internet, or telecommunications failure;
  • payment-provider failure; or
  • another comparable emergency.

Where possible, Bro Dewata will seek a reasonable operational solution, which may include rescheduling, replacing a Service, issuing credit, or providing a refund based on the circumstances and recoverable third-party costs.

31. Responsibility and limitations

Bro Dewata remains responsible to the extent required by law and according to its role in the relevant transaction. Nothing in these Terms excludes a consumer right or liability that cannot lawfully be excluded.

To the extent permitted by law, Bro Dewata is not responsible for indirect loss, loss of profit, loss of opportunity, or loss caused by inaccurate User information, an independent third party, or an event outside reasonable control.

32. Privacy and personal data

Bro Dewata may process personal data to:

  • create and manage accounts;
  • process Bookings, jobs, payments, and payouts;
  • connect Customers with Drivers and Partners;
  • perform identity, document, and vehicle verification;
  • provide support and handle complaints;
  • protect safety, security, and Platform integrity;
  • prevent fraud and investigate incidents;
  • meet legal and regulatory obligations; and
  • improve Services and operational performance.

Bro Dewata may issue a separate Privacy Policy describing data categories, processing purposes, retention, sharing, security, and User rights in greater detail. These Terms do not reduce any mandatory right under applicable personal-data protection law.

33. Changes to these Terms

Bro Dewata may update these Terms to reflect changes in Services, technology, operations, risk, or law. The current version displays its effective date, last-updated date, and version number.

Bro Dewata may give notice of a material change through the Platform, application, email, WhatsApp, or another appropriate channel. A Customer or Driver may be required to accept a new version before making a new Booking, enabling online status, accepting a new job, or using a materially changed feature.

A change will not be applied retroactively to remove an accrued right unless required by law or separately agreed.

34. Complaints and dispute resolution

A complaint should include sufficient information, such as:

  • the complainant's name and contact details;
  • the relevant Booking or job reference;
  • the date and location of the event;
  • a clear explanation of the issue; and
  • supporting documents, photographs, or other evidence where available.

Bro Dewata will review a complaint reasonably and may request further information. The parties should first attempt to resolve a dispute through good-faith communication and consultation.

These Terms are governed by the laws of the Republic of Indonesia. If a dispute cannot be resolved amicably, it may be submitted to the competent courts in Denpasar, Bali, unless mandatory law gives the User a different forum.

35. Severability and waiver

If a provision of these Terms is held invalid or unenforceable, the remaining provisions continue to apply. A failure or delay by Bro Dewata to exercise a right does not waive that right.

By accepting these Terms or using the Platform after acceptance is requested, you confirm that:

  1. you have read these Terms;
  2. you understand your rights and responsibilities;
  3. the information you provide is accurate; and
  4. you agree to the version displayed when your acceptance is recorded.
